5. Mandatory initial mediation session<\/h3>\n
\n\n

The following civil and commercial disputes are subject to the mandatory initial session Article 6- Law 4640\/2019:<\/p>\n

a) Family disputes, apart from those in cases a’, b’ and c’ of paragraph 1, as well as those in paragraph 2 of article 592 K.Pol.D.<\/p>\n

b) Disputes that are adjudicated during the regular procedure and fall under the substantive jurisdiction of the Single-Member Court of First Instance, if the value of the subject of the dispute exceeds the amount of thirty thousand (30,000) euros and the Multi-Member Court of First Instance, in accordance with the provisions of the C. Pol.D.<\/p>\n

c) Disputes for which there is a written agreement of the parties and an arbitration clause is in effect<\/p>\n

In the above cases, for the admissibility of the discussion of the lawsuit that may be brought, a record of the mandatory initial Mediation session is filed together with the proposals of the discussion of the case.<\/p>\n

Excluded from the Mandatory Initial Mediation Session of par.1 are the disputes where the party is the State, OTA or N.P.D.D.<\/p>\n

Recourse to judicial mediation shall not relieve the parties from the mandatory initial Mediation session.<\/p>\n\n<\/div>\n<\/div>\n

6. Online Mediation<\/h3>\n
\n\n

Online Mediation is a practice widespread throughout the world which is also provided for by the new law on Mediation (n. 4640\/2019). <\/p>\n

It has various forms, such as that of standard face-to-face Mediation, only with the use of technology, asynchronous communication between Mediator and parties, and others. <\/p>\n

In this way the resolution process manages to cut across borders and jurisdictions, creating significant advantages for the parties to a dispute.<\/p>\n

Online Mediation requires special Mediation skills and adequate knowledge of technology. Saves travel time and costs.<\/p>\n

The parties can meet with each other and with the Mediator through their computer or mobile screen. <\/p>\n

7. How does Mediation differ from Arbitration?<\/h3>\n

In Mediation the Mediator acts as a catalyst, not imposing a solution, helping the parties involved to find the same solutions among themselves.<\/p>\n
